§ 62-32.1. Abandonment/re-activation.

  • A tap shall be conclusively deemed abandoned if water service is not constructed and established within 36 months of the city's authorization of the tap or payment of the tap fee. For purposes of this section, establishment of water service is satisfied by the issuance of a valid building permit for the structure intended to make use of the tap, provided such building permit does not subsequently expire or become void. Notification of the effective date of abandonment shall be mailed to the last known address of the property owner or manager. If the city engineer determines there is sufficient capacity within the municipal water system, abandoned taps may be revived upon payment of the difference between the original and then current tap fee. The city shall not pay a refund if the tap fee is less than the fee initially paid.
