§ 22-31. Trial by jury.

  • (a)

    In any action before the municipal court in which the defendant is entitled to a jury trial by the constitution or the general laws of the state, such a party shall have a jury upon request. The jury shall consist of three jurors, unless a greater number, not to exceed six, is requested by the defendant. Where the defendant is charged with a violation declared to be a noncriminal offense, the defendant shall not have a right to a jury and the defendant shall not be subject to imprisonment upon conviction of a noncriminal offense. Any person charged with a noncriminal offense and a criminal offense arising out of the same incident shall have the right to demand a jury trial as to all such charges, which shall be consolidated for purposes of trial.

    (b)

    Jurors shall be selected from a jury list as is provided for courts of record.

    (c)

    Jurors shall be paid the sum of $10.00 per day for actual jury service, and the sum of $5.00 per day for each day of service on the jury panel alone.
