§ 58-106. Enforcement.

  • (a)

    Any police officer or code enforcement officer of the city may issue a citation for any violation of this article. If the owner or operator of the vehicle is present when the violation is discovered, no citation shall be issued until the owner or operator has been ordered to cause the vehicle to be removed immediately from the snow route and such owner or operator has failed or refused to comply with such order.

    (b)

    The public works director, any police officer or code enforcement officer may order the removal of any vehicle which is in violation of this article and for which a citation has been issued pursuant to the provisions of subsection (a) of this section. The vehicle shall be removed to the nearest place, where in the judgment of the public works director, the vehicle will not obstruct a snow route.

    (c)

    The owner or operator of a vehicle removed from a snow route shall be responsible for all costs incurred as a result of such removal, in addition to other fines or penalties.
