§ 58-23. Avoiding traffic control devices.

  • (a)

    It shall be unlawful for any person to operate a motor vehicle on any public or private property for the purpose of avoiding a traffic control device.

    (b)

    It shall be prima facie evidence of a violation of subsection (a) of this section upon a showing that:

    (1)

    A motor vehicle was operated at or in the vicinity of an official traffic control device as defined by the model traffic code as adopted by the city.

    (2)

    The vehicle left the main traveled portion of the roadway at or near such traffic control device.

    (3)

    The vehicle subsequently reentered the same or another roadway.

    (4)

    No apparent purpose for exiting the roadway existed aside from the purpose to evade the requirement or potential requirement imposed by the existence or operation of said traffic control device.
