§ 30-112. Definitions

For the purposes of this section, the following words shall have the meaning subscribed to them in this section except where the context clearly indicates a different meaning:

City manager shall mean the city manager or the manager's authorized designee.

Deface shall mean to willfully destroy or damage the appearance of something by removing, distorting, adding to or covering all or a part of such surface.

Graffiti vandalism shall mean any marking, symbol, slogan, logo, wording, phrase, name, or other extraneous painting, drawing, scratching, inscribing, or writing by use of paint, spray, markers, ink, glass cutting or etching tool or cream, or other methods which defaces public or private property.

Remove shall mean the physical removal of the method, means or medium constituting the "graffiti vandalism," or where such actions would irreparably damage the underlying surface, the defacement shall be covered up or re-surfaced by means such that the entirety of the surface is uniform and substantially similar to its pre-existing condition.

Responsible party shall mean an owner or an entity or person acting as an agent for an owner by agreement, who has authority over the property or is responsible for the property's maintenance or management.
