§ 10-115. Imminent danger.

  • (a)

    If an inspector finds that any structure, premise or portion thereof presents an imminent hazard to life or health; the inspector will post the premises and order the property be vacated. Upon an order to vacate, the property; or portion thereof, will be posted as "Dangerous, Do Not Occupy," and written notification of the violations that deem the property, or portion thereof, as an imminent hazard will be served as required in section 10-111.

    (b)

    It shall be unlawful for any person to remove or deface the posted notice, or to occupy the property or to enter the structure, except for the purpose of repair. The violations identified as causing the property or portion thereof, shall be corrected and re-inspected before the posting is removed and the property, or portion thereof, is reoccupied.

    (c)

    The owner or property manager may appeal the order to vacate to the hearing officer, in the same manner as stated in section 10-114, except that the notice and order shall not be suspended pending a hearing.
